iGarden Swim Jet P Installation Terms and Conditions (USA)
I. Scope of Installation Service
A. Service Content
This installation service is strictly limited to the "standard installation service" of the iGarden Swim Jet P (Hereinafter referred to as "Swim Jet P", "swim jet") or any bundle that includes the Swim Jet P alongside other iGarden products (collectively referred to as the "Products").
* Please note that this installation service does NOT include:
- Any linkages or changes to installed pool equipment (e.g., pumps, fountains, etc.).
- Any electrical installation or alteration service other than the swim jet system.
- Any preparation of the necessary additional materials for the installation with or without explicit instructions from the user.
- Any structural modifications, wall openings, patching, painting, or non-electrical work needed to complete the installation.
- Replacement or addition of electrical components, such as the Over-current Protection Devices, circuit breakers, fuse boxes, junction boxes, electric meter box, distribution panel, etc.
- Existing electrical panel upgrade (normally no upgrades are involved).
B. Installation Conditions
The user's home and yard electrical system must fully comply with all applicable local government regulations and electrical standards. Any unauthorized modifications to the home circuit—i.e., changes made without official government approval—will likely render the property ineligible for installation.
In such cases, the installation cannot proceed. Furthermore, in the event of any unforeseen circumstances that affect the safety, legality, or practicality of the installation, iGarden reserves the sole right to determine the final feasibility of performing the service.
C. Territory:
Our installation service covers most areas in the contiguous United States. Please verify coverage by entering your ZIP code during checkout. If the order cannot be placed, it indicates your area is currently not serviced - please contact iGarden customer support for assistance. Note: ZIP code verification may have minor discrepancies. If "Service" is ultimately unavailable in your location, we (iGarden customer support) will contact you and handle the after-sales matters.
D. Service Benefits
The installation service benefits promoted are exclusively available to users who place an order and complete a successful payment for the installation service through iGarden official websites ( https://igarden.ai/ & https://store.igarden.ai/ ). Orders made through third-party platforms or other sales channels are not eligible for these benefits.
II. Installation Fee and Additional Costs
A. Installation Service Fee Coverage
Standard Installation Service – The service fee ONLY covers the general installation labor costs, excluding the application fees for the potentially required electrical permit with the local AHJ (Authority Having Jurisdiction), such as the labor cost for preparing the necessary documentation, the labor cost for completing the application process, and the permit application fee payable to the AHJ.
B. Exclusions from the Installation Service
iGarden installation service is free, listed on the official iGarden website; through it does NOT include the following additional costs, which must be borne by the user:
● All necessary materials to connect the Swim Jet P system to the upstream power distribution panel, which is referred to the yard load center normally.
● Replacement or addition of electrical components such as circuit breakers, junction boxes, etc.
● Application fees for any permits, including but NOT limited to the electrical permit with local AHJ, if required by local regulations.
● Any fees for those conditions not covered by the Standard Installation Services as described above.
C. Payment Method
Any potential additional fees for materials or labor beyond the standard installation service will be identified and disclosed to you with a separate quotation for your prior approval before non-standard work begins. You may then choose to approve and pay the electrician directly for these additional services, or decline and proceed only with the standard installation. iGarden reserves the right to the final interpretation of the installation service and its applicable scope.
III. Service Limitations and Liabilities
A. Independent Service Agreement
The installation service constitutes a direct agreement between the customer and the electrician. iGarden is NOT a party to this agreement and therefore assumes no responsibility or liability for the electrician’s pricing, workmanship, performance, or service quality.
B. Service Refusal Based on Yard Assessment
First, we will use the accurate information you provide about the site environment (yard & pool) to create a customized plan in advance, considering the complexity and variety of each home's yard and pool. You may have the right to refuse to fill out the form or provide the requested information to protect your rights. Nonetheless, we heartily recommend that you complete the "iGarden Installation Information Form" as soon as possible after purchasing the iGarden Swim Jet P. Based on the minimum scope of clear purposes of use, we commit to safeguarding your personal information and data effectively in accordance with the applicable local laws.
However, if you choose NOT to fill out the "iGarden Installation Information Form" or do NOT to provide valid details about on-site installation, the electrician reserves the right to refuse installation if an on-site evaluation finds your pool or patio unsuitable for installation. In such cases, the user remains responsible for the cost of the on-site assessment, whether or not the installation is carried out.
C. Liability for Unauthorized Installation
Nothing in these Terms & Conditions and in particular within this "Liability" section shall attempt to exclude or limit liability that cannot be excluded under applicable law.
iGarden shall NOT be held liable for any product issues, defects, or damages resulting from installation performed by an unauthorized installer or electrician. In such cases, the user shall bear full responsibility for any required after-sales service, maintenance, or repairs, and such services may not be covered under iGarden’s standard warranty or support policies.
D. No Refund after Installation
Once the installation service has commenced, neither the installation fee nor other costs related to installation is refundable. If the user is dissatisfied with the iGarden product and request a return after installation, the user shall be responsible for (a) the non-refundable installation fee & the additional installation-material costs; and (b) the full removal costs. These costs will not be covered by iGarden under any circumstances.
E. Cancellation After On-Site Assessment
If the user insists on having an iGarden authorized electrician conduct an in-home survey to obtain detailed environmental information and cancels the installation service after the electrician conducts an on-site evaluation and before the product installation begins. The installation fee will be refunded, less a deduction for the on-site assessment fee. The on-site assessment fee may be up to USD $200.
IV. User's Responsibilities
A. Accurate Information Provision
When placing an order and fulfilling the "Service"-oriented form, the user must provide accurate personal details, including the shipping address and the installation address. The user is also responsible for ensuring that someone is present at the premises and that the provided contact information is reachable at the time of the installer’s visit. If the user needs to reschedule the installation, they must notify iGarden customer support team via the official hotline or other designated methods at least one (1) day in advance. Failure to do so may result in an on-site visit fee of up to USD $200, which will be charged to the user.
B. Installation Conditions Assurance
The user shall ensure that his/her residence (or the installation address), yard's existing distribution panel, and the installed electrical load equipment meet the required installation conditions. If installation cannot proceed, or if additional costs arise due to issues with the home’s infrastructure or non-compliance, the user shall bear full responsibility for such circumstances and related expenses.
V. Disclaimers and Final Interpretation
A. Service Interruption
iGarden does NOT guarantee that the installation service will be free from interruptions, delays, or failures. iGarden shall NOT be held liable for any service interruptions caused by force majeure, acts of third-parties, or circumstances attributable to the user.
B. Limitation of Liability
To the fullest extent permitted by applicable law, iGarden and its affiliates shall NOT be liable for any indirect, incidental, or consequential damages arising from or related to the installation service, including but not limited to property damage, loss of use, or loss of profits, unless such damages result from iGarden's gross negligence or willful misconduct. In all cases, the total liability of iGarden and its affiliates shall be limited to the amount actually paid by the user for the installation service.
C. Wall* Damage
* "Wall" in the definition of installation service means 1) a physical wall in the broadest sense of the word, and 2) any supporting materials or constituent objects with sufficient capacity and places (e.g. a yard wooden standing base ) to hang the swim jet's control box.
Necessary drilling or structural modifications that cannot be omitted during the installation process are deemed standard and necessary procedures to complete the service. iGarden and the installer are NOT responsible for repairing (or servicing) any foreseeable or potential wall damage or alterations (e.g., drilling, mounting, or cutting) that may occur during the installation process.
D. Final Interpretation and Updat
iGarden reserves the right to update these Installation Terms and Conditions (T&C) from time to time, and to interpret these Installation Terms and Conditions. The most current version will be posted on our website and our valued users are encouraged to review these Installation Terms and Conditions periodically.
VI. iGarden Swim Jet P Installation - Warranty Policy
Announcement:
This Warranty Policy shall apply solely to installation service procured via iGarden’s official website, accessible at iGarden US & iGarden.com/us.
iGarden’s installation service will be carried out by authorized third-party electricians in compliance with applicable local electrical codes and safety regulations. We stand behind the quality of our installation workmanship and provide ongoing support throughout the product warranty period. Should you encounter any issues resulting from the installation, please reach out to iGarden customer support via e-mail or the iGarden hotline for prompt assistance.
Your Statutory Rights
This warranty does not limit or replace any statutory rights you are entitled to under the local consumer laws. The benefits provided by this iGarden Installation warranty are in addition to, and not in substitution for, any legal rights you may have under applicable laws and regulations.
Scope of Installation Warranty
This Installation Warranty for the Swim Jet P covers any defects or failures resulting from improper installation workmanship. Should your Swim Jet P system malfunction due to non-compliant installation, iGarden will dispatch a certified electrician at no cost to repair or re-perform the installation, ensuring your system is safe, reliable, and fully compliant with local codes.
Coverage Includes:
1) Physical installation of Swim Jet P Series, including but not limited to the jet unit and the control box.
2) Electrical connections between the jet unit, control box, and other iGarden accessories.
3) All wiring within the control box and connection to the power distribution panel.
4) Damage to third-party products (e.g., circuit breakers) directly and solely caused by the negligent installation of Swim Jet P System, subject to the Limitation of Liability clauses herein.
NOTE: iGarden will cover all repair, correction, or re-installation services for the above, including all necessary labor and materials.
Warranty Exclusions
This Installation Warranty applies solely to the quality of installation service provided. Product-related defects are covered under the separate iGarden product warranty policy, available at https://store.igarden.ai/pages/warranty-policy.
The following are NOT covered by this Installation Warranty:
● Defects in third-party products (e.g., externally sourced breakers, cables) not caused by our installation.
● Damage resulting from misuse, accidents, neglect, vandalism, accidents, or intentional or negligent acts unrelated to installation workmanship.
● Repairs, alterations, or disassembly by unauthorized personnel.
● Damage resulting from external events such as lightning, power surges, fire, floods, or other natural disasters.
● Improper installation or operation in environments that do not meet product specifications and the user manual, including but not limited to excessive moisture, over-voltage power supply, freezing temperatures, poor ventilation, or other hazardous conditions.
● Normal wear and tear of materials such as wires and breakers.
● Regulatory changes or new permitting requirements arising after the installation is completed.
● Commercial use of the system, or any use inconsistent with iGarden’s official guidelines or the user manual.
● Installations not performed by an iGarden-authorized electrician.
● Unauthorized modifications to the system's electrical configuration or wiring replacement, etc.
● Products or services outside the warranty period, or without valid proof of purchase.
● Failure to comply with the Product/installation instructions.
● Willful damage, neglect, or negligence by the user.
To maintain this installation warranty validity, the user must adhere to all applicable local laws and regulations—including but not limited to the National Electrical Code (NEC) Article 680, local building and electrical codes, and homeowners’ association (HOA) requirements—as well as follow iGarden's product usage instructions and any guidances provided by iGarden.
Warranty Claim Process
Here's the process to follow if you believe there is a workmanship issue with your installation:
1) Report the Issue Promptly
Contact the electrician, iGarden customer support, and service provider as soon as possible to mitigate any potential risk. Please have your installation order number and installation date ready.
2) Submit Your Documentation
Provide a detailed description of the issue, along with any supporting photos or videos that can be safely obtained.
3) Schedule an On-site Inspection
iGarden will acknowledge your claim within a commercially reasonable timeframe. If the issue appears to be warranty-related, we will make every reasonable effort to dispatch an authorized electrician to contact you and schedule an inspection at your earliest convenience.
4) Receive a Resolution
If the issue is confirmed to be due to iGarden's installation workmanship, we will implement a suitable remedy at no cost to you. This may include, but is not limited to, repair, correction, or complete re-installation, as deemed appropriate.
We are committed to transparent communication and timely resolution to minimize inconvenience.
Customer Responsibilities
To maintain warranty validity:
Use the system in accordance with product manuals and avoid overloading or unauthorized modifications.
Do not hire personnel unauthorized by iGarden or an un-licensed installer to alter the installation.
Perform any recommended maintenance or inspections.
Report anomalies promptly.
Keep the system connected to the network for remote inspection when requested.
Restoration of Walls & Landscaping
While our installation standard practice is to take reasonable care to avoid damage, this warranty does NOT cover incidental cosmetic impacts to drywall, exterior surfaces, or landscaping. For any concerns about aesthetic disruption following installation, please contact iGarden customer support for clarification in time.
Warranty Transferability
This warranty is granted to the original purchaser at the registered installation address. It is automatically transferred to any subsequent homeowner of that property, provided that the installation has not been altered or modified, and valid proof of the original installation is presented upon request. All warranty terms and services remain tied to the original installation address.
iGarden's Limitations Of Liability
To the fullest extent permitted by applicable law(s):
iGarden's sole and maximum liability under this warranty is strictly limited to the repair or correction of defective installation workmanship as described in this document.
In no event shall iGarden be liable for any indirect, incidental, consequential, or special damages, including but not limited to damage to other property, loss of use, or personal injury arising from an installation defect.
The total aggregate liability of iGarden shall not exceed the total installation fee paid by the customer.
iGarden reserves the right to make a reasonable number of attempts to remedy a defect in the course of providing installation services. Should the issue(s) persist after two such attempts, iGarden may, at its sole discretion, offer a partial refund as compensation, or, depending on the circumstances, provide a solution and bear the reasonable cost of removing the products (if needed).
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.
